Welcome to HyperHired.com (“HyperHired,” “we,” “our,” or “us”). By accessing or using our website, services, or platform (collectively, the “Services”), you agree to comply with and be bound by the following Terms of Service (“Terms”). Please read these Terms carefully before using the Services. If you do not agree to these Terms, you may not use our Services.

1. Acceptance of Terms

By accessing or using HyperHired, you confirm that you are at least 18 years of age or the age of majority in your jurisdiction and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a company or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Services Overview

HyperHired provides tools, resources, and services for recruitment and job placement. This includes connecting employers (“Clients”) with candidates (“Users”) through our platform. While we strive to facilitate successful recruiting and hiring processes, we do not guarantee employment, job offers, candidate placements, or results in general.

Client success stories and video testimonials on this website or on affiliated HyperHired domains, presentations, etc, are not necessarily indicative of typical results. Your typical results will vary depending on unique circumstances such as your ability to follow our process and your ability to retain candidates following placement.

3. User Accounts

a. Account Creation:
To access certain features of the Services, you may be required to create an account. You agree to provide accurate, complete, and current information during registration and to update your information to maintain its accuracy.

b. Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. HyperHired is not liable for any unauthorized use of your account.

c. Account Termination: We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or engaged in prohibited activities.

4. Prohibited Conduct

You agree not to:
- Use the Services for unlawful purposes or in violation of any applicable laws or regulations.
- Submit false, misleading, or incomplete information.
- Impersonate another person or entity.
- Engage in spamming, phishing, or other disruptive activities.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code or proprietary processes as it relates to our Services.
- Exploit the Services for wide-scale commercial purposes outside the scope permitted by these Terms.

5. Payment and Fees

a. Fees:
Certain Services may require payment of fees. Fees will be disclosed prior to your purchase or use of the applicable Services.

b. Billing: You authorize us or our third-party payment processor to charge your payment method for all fees incurred.

c. Refunds: All payments are non-refundable unless expressly stated otherwise in the signed Service Agreement.

d. Late Payments: We reserve the right to suspend or terminate your access to Services for late or non-payment.


6. Intellectual Property

All content, materials, and features available through the Services, including but not limited to text, graphics, logos, and software, scripts, job posts, and processes, are the intellectual property of HyperHired or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written consent.

7. Third-Party Links and Services
The Services may include links to third-party websites or services that are not owned or controlled by HyperHired. We are not responsible for the content, policies, or practices of any third-party sites or services. You access these at your own risk.

8. Disclaimers

a. No Guarantee of Results:
HyperHired does not guarantee the success of any job search or hiring process.

b. As-Is Basis: The Services are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied.

c. Limitation of Liability: To the maximum extent permitted by law, HyperHired shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from or related to your use of the Services.

d. Services Rendered: You are engaging with HyperHired's services at your own risk. Past client results are not necessarily indicative of results you may see. In the event you initiate a chargeback or wrongful dispute, the Services provided are to be considered performed immediately upon signature of the Service Agreement. You agree that "product/service not received", "product/service did not meet expectations", and similar jargon are not valid grounds for a chargeback or monetary dispute. All payments made to HyperHired are final and wholly non-refundable.


9. Indemnification
You agree to indemnify, defend, and hold harmless HyperHired, its affiliates, and its respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or connected to your use of the Services or violation of these Terms.

10. Termination
We may terminate or suspend your access to the Services at our sole discretion, with or without notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately. No pro-rata refunds are provided.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of the State of Florida, in which HyperHired operates, and without regard to its conflict of laws principles.

12. Dispute Resolution

a. Negotiation:
In the event of a dispute, the parties agree to first attempt to resolve the matter through informal negotiation.

b. Arbitration: If negotiation fails, the dispute shall be resolved by binding arbitration in accordance with the rules of Broward County, Florida.

c. Class Action Waiver: You agree to resolve disputes on an individual basis and waive your right to participate in a class action or representative proceeding.

13. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Services. Your continued use of the Services after any such changes constitutes your acceptance of the updated Terms.
